2. China Weighs Locking AI Model Weights, Expanding Restrictions Beyond API Access

MOFCOM consultations have broadened to potentially restrict downloadable model weights – not just API access – for Qwen, Doubao, GLM-5.2, and DeepSeek R1, with reports also citing possible prohibitions on Chinese companies using TSMC for certain AI hardware. The proposal remains under discussion as industry pushes back, but the scope has widened significantly since the July 7 initial consultations.

Analysis finds only approximately 10 EU member states – Ireland, Spain, Lithuania, Finland, Italy, Germany, the Netherlands, Poland, France, and Cyprus – have advanced public enforcement infrastructure for GPAI and Article 50 obligations taking effect August 2. The other 17 member states have limited capacity, meaning first-year enforcement will be geographically concentrated rather than uniformly applied across the single market.
