1. New York Becomes First State to Impose Moratorium on Hyperscale AI Data Centers
Governor Hochul signed an executive order on July 14 banning new data center construction at 50MW or more for up to one year – making New York the first state to freeze AI infrastructure buildout while regulators develop environmental impact and community-benefit frameworks. The order responds to a 68% rise in residential electricity prices since 2019 and requires companies seeking exemptions to negotiate community benefits with local governments.

2. EU Digital Omnibus Still Unpublished as August 2 GPAI Enforcement Window Narrows to 15 Days
The EU Digital Omnibus – signed July 8 and carrying the December 2027 deferral for Annex III high-risk AI systems – has not yet appeared in the Official Journal, meaning companies cannot formally rely on the extended deadline until publication plus a three-day entry-into-force period clears. If publication does not occur by approximately July 30, the high-risk deferral will not take legal effect before the August 2 GPAI enforcement date.

3. EU Cybersecurity and AI Action Plan Establishes Pre-Market Frontier Model Testing Framework
The European Commission’s nine-point action plan, presented July 7, will build dedicated pre-market evaluation capacity for frontier AI cybersecurity risks – with infrastructure expected operational in 2027 – and tasks ENISA with creating secure AI testing tools for critical sectors including energy, health, and finance. The plan strengthens AI Act enforcement ahead of August 2 GPAI obligations and signals a structural shift toward pre-deployment government oversight of frontier models in the EU.
